Liability Waiver and Release of Liability

Hannah Kealoha Adventure Tours LLC

In consideration of participating in the tour provided by Hannah Kealoha Adventure Tours LLC, I hereby agree with the following:

1. Acknowledgment of Risk: I acknowledge that participating in a land-based/road-based tour involves inherent risks, including but not limited to, personal injury, property damage, or even death. I fully understand the nature of these risks and voluntarily assume all risks associated with participation.
2. Compliance with Instructions: I agree to follow all instructions given by the tour guides and understand that my failure to do so may result in my expulsion from the tour without a refund and cause safety concerns. I acknowledge the importance of being back to the vehicle at the times designated by the guide and agree to be back at the vehicle at the designated times as instructed by the tour guide.
3. Release of Liability: I hereby release, waive, and discharge Hannah Kealoha Tours LLC, its owners, employees, and agents from all liability for any loss, damage, or injury (including death) to myself or my property, including any claims arising out of negligence. This release applies to any claim that may be made by me, my family, or my heirs. Participants under the age of 18 must have parent(s) or guardian(s) present to sign on their behalf.
4. Medical Clearance: I declare that I am physically fit and do not have any medical conditions that would restrict my ability to participate in the tour. If I experience any medical issues during the tour, I will immediately notify the tour guide.
5. Indemnification: I agree to indemnify and hold harmless Hannah Kealoha Adventure Tours LLC from any claims, losses, or damages that may arise from my participation in the tour, including but not limited to attorney fees, medical bills, property damage and loss of property.
6. Governing Law: This waiver shall be governed by and construed in accordance with the laws of the state of Hawaii, USA.
